Joyland Wichita Status?

They just left the rides out in the elements for the 2 years it was closed. I did find out they stored them on sight , so I'm not as worried now.I think they are just expecting a long legal battle.with any Luck they will get access to the park as quick as they did last time they were kicked out.
I wonder if Stan will give the horses a fresh coat of paint this year, so they can keep looking good. They really need to paint the coaster this year too. When they painted it in 2001, I never saw much wood replacement on it in 2002, so I think the paint protects the wood at least a little bit. *** Edited 4/26/2007 3:13:17 PM UTC by snuggles***
I'm going to go over there in about 30-45 minutes and take some pictures after I mow my lawn...
Quote:We have been illegally removed from the property a few weeks ago by the Nelsons. They took possession by cutting off all the locks to the park and replacing them with their own. We are preparing a 40 million dollar lawsuit against the City of Wichita, the Nelsons, Occidental brokerage, Haas Wilkerson Insurance, Continental Insurance and Joe Bixler the roller coaster inspector. By law we have to give 120 days notice of intent to file a lawsuit against the city so we will first file against the others and enjoin the city once we comply.

We have planned all along to build a strip retail center on Hillside...but the zoning is not correct and the city and the Nelsons never followed through on rezoning the property to CG as promised, when we first purchased the park.

The coaster was named the nightmare because that is what it looks like, even though it is structurally and mechanically sound. The courts will have to decide who was at fault here and we are confident we will prevail. We have never had problems with the city and associated players in a deal being so dishonest and unethical and we are confident the jury will see it the same way. Joyland's future is going to be up in the air until the court fights are over.

The Nelsons did this same type of thing to David Rohr and got away with it. We are not going to be as easy.. We are suing in federal court so we can avoid the home town judges and court system and give us a level playing field.

The Wacky Shack fire was minimal and nothing will be sold from the park legally until all these issues are resolved. The Nelsons have sold or attempted to sell thousands of dollars of items that were an integral part of the operations of the park. Criminal charges for mail fraud, wire fraud and grand theft are being investigated and we have ten pages of items stolen as evidence....maybe the Nelsons can visit Leavenworth as a potential retirement facility.
Stay tuned as we get geared up for a major lawsuit and we attempt to expose some of the corrupt business practices taking place in Wichita. We are attempting to get national media coverage (Primetime, 20/20, Fox News etc.) so all the US can see what goes on with the Network in Wichita. The purpose will be to keep other entrepreneurs and businesses from being defrauded by the city and other unethical business leaders in the city. Wichita needs to be exposed for what they really are. support Joyland at www.explorer7004.com

Wow! Looks like someone found good legal representation. Go get'em. That is what the courts are for.
I cant wait. after all they have been through its time for everyone to see the other side.

I can't wait to see this court battle either. It will be no surprise if the wild west world people, or even the city were paying off residents to complain about noise from Joyland. Its time to expose our crackpot local government for what they really are.
Here is another e-mail I got back from Michael Moodenbaugh. I inserted the things in parentheses to let you know what he was talking to me about.

"We intend to complete the sale with the Nelsons. What the Nelsons do we can't control, but we can and will prove damages...the trial will be in federal court in Tampa, Florida. Yes it was a skating rink (building in the parking lot) ...there was a fire and it shut down, we tried to reopen the skating rink, but the city denied it based on current zoning. The park had not operated the rink for more than 5 years so Joyland has lost the right to ever do it again....unless the city ok's it (or zoning changes), which they did not. City has been so helpful, not!!! "

Its great to see their dedication to exposing our corrupt local government, and restoring the park.

What is the deal with the Nelsons, anyway? It seems to me that they keep on trying to sell the park but something happens with the people they're going to sell it to and the park gets tossed back to them. Are they the good guys or the bad guys? Are they keeping the park alive, or are they hindering it's future? I thought I knew the answer to that, but now I'm not so sure.
There are some surprising similarities to the way they treated David Rohr and the way they
have treated the new management.Kicking them out failing to follow through on promises etc.
I think the park has been in a steady state of decline since the nelsons took over, or at least from some point in their ownership. This is just my personal opinion.

In what seems like a totally unrelated note, the city of Wichita also may have lost the United States Bowling Congress national bowling tournament in 2011 because the city council wouldn't agree to upkeep the city's convention center.

Now you may be wondering what the heck is so important about a bowling tournament. Well, the national USBC event routinely draws 10000+ teams, and routintely impacts the local economy with more than 100 million in additional revenue.

So, it seems to me that a city dumb enough to not provide standard contract provisions for the USBC would be dumb enough not to support Joyland properly.

If I have offended anyone in Wichita, I'm sorry, but you may want to take a look at your city government.

Subject: Joyland- FYI

Councilman Skelton,

FYI

I will call Allen Mairs and ask him to settle my ownership of Joyland with the Nelsons and discuss the operating license with the city of Wichita. I will give him until August 1, 2007 to resolve all of the issues. Without the support of the city council, the mayor, and the K15 association I will not be in Wichita to operate an amusement park.

Your own city attorney has stated the legal battle with the Joyland owners and the Nelsons will take 3-5 years. I believe you saw the estimated cost to the city to fight a Joyland legal battle. I hope you and the city administration make the correct decision for the citizens of Wichita.

I look forward to working with you in the near future.

Sincerely,

Robert Barnard

Sounds like the balls are really on the line now (No, I've no idea what that means).

So does this mean Barnard is pretty much saying "Hey, fighting is pointless and costly, let's just settle this right now."?

Hey, they should be more open to the idea of Joyland coming back now that WWW is toast.

Please sign my online petition to support Joyland. this is a critical point and anything we can do to convince the city to work with Joyland will be instrumental in insuring the parks future.
Thanks

The protest was a success with coverage on KMUW 89.1 , KSN and KAKE.Thanks to all the stations who chose to cover the protest.Im sure the city council heard the honks of support. We also began gathering signatures for the physical petition. The next step will be a petition drive and and potential protests during more worker friendly hours. Be sure to watch the protest video at http://www.explorer7004.com

Two weeks ago we started a petition to save Joyland. There is an August 1st deadline for the City, Nelsons, and K15 association to work things out with Joyland Amusement Park. We can use all the signatures we can get. This is important as the alternative to working things out is a 3-5 year legal battle. If this happens no one wins.

I hate to say it, but if a legal battle occurs, that will likely be the end of Joyland. I say sign the petition, even those of you convinced they do nothing. It certainly can't hurt.
