You are correct, but in my recent case, registering for a trademark would have really helped me. A trademark is implied as soon as it's used in commerce. I was planning on using a title of a song, that my old band wrote, as my new band's name. The problem that occurred was that an ex-band member was planning to use the same name. I reluctantly gave up my rights to the name, because we both have the right to use it, and I didn't want to argue to much about it. I have a lot more band names in my consideration box anyway.

Unless you're those assholes at Monster Cable and you think it's appropriate to sue Monster Mini Golf for infringement. I think they later dropped that one after a storm of hate-mail, though.

I swear what's next? Are the parks going to sue each other over trademarked color schemes for their rides?Still leave it to CF to pick a lousy name as a substitute....Posessed ranks right up there with drop tower as the lamest name for an attraction ever concieved.

Reminds me of a PA band who call themselves "Poptart Monkeys." They were sued by the Kellogg company over their name. They haven't changed it, so I guess nothing came of it.
