A woman is suing SeaWorld Orlando after a duck allegedly entered a roller coaster's path and struck her in the face, knocking her unconscious and injuring her. She is seeking at least $50,000 in damages for what she says is negligence on the part of SeaWorld.

So the negligence was... building the roller coaster in the first place? It seems like her entire argument was that the company put the public in danger by building something outside and near water. That's a slippery slope that no one could foresee.

I doubt this ever sees a trial. Even Morgan & Morgan has to know this, and that's why they're after $50k and not a million.

The liability for something like this should solely rest on the rider.
they choose to ride a fas t riding vehicle highly exposed. It’s no different than someone that chooses to ride a motorcycle without a helmet.
I don’t pay attention to the signs on rides, but do they have a disclaimer about something like this? They absolutely should after the Fabio incident.
Never do a front row night ride at CP unless it’s Halloweekends. Heck, CP is the only park that I will wear sunglasses on rides at night, they are my bug eye shields.
