Six Flags Worlds of Adventure sued for 2000 Villain accident

A Wisconsin woman who was struck in the head by a thrown object while riding Villain at Six Flags Worlds of Adventure has filed a suit against the park for her injuries. The suit says that the park knew people had thrown objects in the path of the ride prior to the accident.

Yeah, because God knows you'd be OK with the fact that surgeons had to remove part of your skull after an accident that the park could have prevented. And she's totally responsible for her own actions. She was pretty stupid to think that she could safely ride a roller coaster without people throwing stuff at it. Right.

Hey Jeff! Accidents happen. Nothing more or nothing less. Sure I would be mad and want revenge if my skull was broken. However, I also realize that there is such a thing as misplaced anger. I think you are right on about the legal issues. The park will most likly lose this case! This does not mean that it is ethically correct. You ask, what was the injured rider responsible for? I answer that the rider, like everybody else, is responsible for knowing that all actions they take may have consequences. Anytime you put yourself ina situation in which you are traveling at high speeds in an open vehicle, there is a chance that you could get hit by a flying object such as a bird, falling part (this would definatelt be the park's fault), or a cell phone/rock thrown by some A-hole! The odds of this are not likly, but it does happen! That is the risk all riders take when the choose to board an amusement ride.

You can get mad and argue all day about the legalities of the case. From a legal standpoint I'm quite sure you are correct. From an ethical standpoint, there is a strong opinion held by many that this was nothing more than a terrible accident at the hands of a criminal. The park should not be required to go through unnecessary expenses and expendatures to alleviate EVERY possible accident that can happen. May I dare say, that it is not possible for ANY park to take every action needed to make the risk factor zero!

damn birds that poop on my car have ruined the paint job.

Funny stuff thrillerman! I had a bird poop on my shirt once while at CP. I had to buy a new shirt. According to the guiding principals of some on this site, I could sue CP and win my case for the cost of the shirt---plus maybe some of the emotional damage I suffered at the hands of having to walk down the midway with poop on my shirt while patrons laughed at me! This says nothing of the pain and suffering I had from the sting!

This was a completely preventable incident that CP had prior knowledge of, or should have had prior knowledge of! How many cars and shirts have been ruined at the hands of those pooping birds?

CP needs to build a net over the entire park, cost be damned, to prevent this needless property distruction. They can use TTD as the center post for the tent! I will also say that this is a serious accident just waiting to happen. I can tell you from experience that it stings like crazy when that poop hits the skin. One of these days an innocent patron will be looking up and the standing but not operating TTD (sorry for the low dig---I could not help myself---I really to love CP) and the force of this flying poop will take an eye out!

CP knows this is an issue and still they continue to sell food and do nothing to put up the protective netting that we all know is needed to prevent the tragedy! I'm sure this looks funny now! But what about when this really happens! Are you going to be laughing at the one-eyed patron?

I'm interested in how those of you who ethically defend the SF lawsuit can answer this one!? You may brush it off as funny and absurd, but believe me, this is the direction we are heading if we all continue to accept this crap (weak pun intended)! :-)
