Six Flags Great America sued over delay in medical treatment.

The parents of a 14-year old girls are suing Six Flags Great America for allegedly keeping the girl in first aid for six hours after she fractured her ankle. The suit seeks $50,000 in damages.

You cant buy "general admission" passes @ Kennywood under 18 (or is it 21?). But ANYONE can buy a 'ride all day' pass, regardless of age. ALL parks I've been to (save *maybe* Magic Kingdom, but including DisneyLand) had minors (teens) sans leurs parents. Dont act so shocked that people drop their kids off!

Yeah, people drop their kids off at parks all the time.  No biggie....or at least.....in most cases, no biggie.

If the park had called an ambulance with no life threatening injury either:

1) The ambulance most likely would have done nothing without the consent of a quardian except chaged the park for a trip.  If this were the case the park might have covered themselves legally, but not helped the girl.

2) On the off chance that the ambulance had transported her or the paramedics had treated her, the park could have been held liable for any negative outcome, ambulance wreck, medical complication, etc.  Also, the girl would have been out of the parks view (They can't legally control), and could have just walked out of the emergency room any time she wanted to.  Think of the law suit possibilities of that.

Conclusion:  The park probably took the right action.  The only advantage to calling an ambulance might have been that it could provide an independant determination that the injuries were not life threatening.

I must disagree with the park for the following reasons:

If an ambulance had been called, then any professional opion would have then rested on the trained medical professionals.

The cost of possibly being charged is far less than what it will be to hire a lawyer for this case and the ambulance cost most likely picked up by the park insurance.

And finally, by erring on the side of safety . . . they demonstrate concern for their patrons, not their pocket books which helps to reduce liability.

When my 8 yr old son was slightly injured on a water slide in a major water park (left un-named for all you ambulance chasers) by hitting his head on the way down.  I appreciated the fact that upon my son reporting the incident at the bottom, they immeadiately stopped the slide, imoblized him and had an ambulance waiting to transport him to the hosptial before realizing that I was at the top of the slide.  It turned out to only be a bump on the head . . . but the professionals made the determination . . . not the park staff.

Not All Coasters are Created Equally

By Illinois law paramedics require a perants consent before a minor(Under 18) can be even treated or transported anywhere. Also by illinois law SFGam can not give any medice or treatment to a minor without perantal consent. I was in a major car wreck when i was 17 and i had to wait for my perants to get there before i got any treatment and get transported to the nearest hospital. SFGam does have EMTs on there property and on-call when needed. These perants that are suing Six Flags for the incedent is their way of getting money for nothing. Six Flags Great America did everything right and did everything they could do required by law. And if SFGam did take her to the hospital with out a perantal consent then they could be sued for that, especially for neglagence if something worse would of happened at the hospital or on the way there.

What ever happend to consent forms for minor athletics? When I was in high school to be on any sports team you had to have a signed release that among other things allowed your child to be taken to a hospital or otherwise recieve medical attention. And YES the coaches had the forms with them at all times!

Oh and No Fear, you think a big (behind) company like Six Flags doesnt keep "injury defense lawyers" on retainer at all times? They'd be dumb not to.

Yes, I have a stack of consent forms for my kids that are always with me. I'm only responsible for them when they're on the court playing in a a game or at my practice. We don't even allow them in the gym until they've signed the consent form.

You can sub in volleyball between rallies after being recognized by the umpire (down official). In club and international, you also have a libero player who can sub in for anyone an unlimited amount of times, during dead balls only, but without permission from the official.
