Lawsuit possible in Darien Lake death

It appears more likely there could be a lawsuit in the wake of a fatal roller coaster accident at Darien Lake Theme Park earlier this month. A well-known Buffalo law firm has begun assisting in the investigation into the death of Army Sergeant James Hackemer. An investigating attorney says a jury reward could be reduced if they find Hackemer is partially at fault.

Even in Ohio, if the disclaimer were to say they aren't responsible for your death, it is well beyond implied that you're not going to die by getting on a ride. It means nothing.

Even since this incident had taken place I have noticed on this and other sites where the links to the stories had came from Buffalo's WGRZ ( NBC ) and WIVB ( CBS ) but NOT WKBW ( ABC ).

As a long time ( though now former ) broadcaster myself I wonder if this is due to WKBW firing most of their experienced news staff over the years in favor of those with much less experience ( meaning CHEAP ) such as those straight out of high school and college. OK for small market but Buffalo?

Anyway I would love to see WKBW's take on this. My guess is that they would claim that this vet and the staff were all partying just before thie accident just to "make it more interesting". As Scott Fybush from FOX Rochester, NY would say "...how the mighty has fallen". !!!
