Lassiter civil suit against Six Flags Kentucky Kingdom to start January 2010

Jefferson Circuit Judge Barry Willett set a trial date of January 2010. He also required attorneys to mediate the case and set a November 23, 2009 deadline for any settlement. The plaintiffs' attorney says they've amassed hundreds of documents in the trial phase of the case.

I guess this is just standard operating procedure, but if they think they aren't going to have to pay up for this, I'm at a loss.

Actually, is this aseperate case? I mean there is a liability settlement, right? Are they attempting to double dip here?

This says to me there is no settlement yet. I know the park and their insurers expect to pay. There's little doubt in that. It's just a question of how much and whether it's going to go to trial.
There's also the possibility that, at least in a legal sense, Six Flags thinks they might be able to pin some or all of the liability for the incident on someone else. Unlikely, of course, especially given the facts of the case as published so far, but there is that possibility.
