Knott's sued over aneurysm death on Montezooma's Revenge

Relatives of a woman who died of a brain hemorrhage after riding the Montezooma's Revenge roller coaster at Knott's Berry Farm last August have sued the amusement park and its owner. Although Justine Bolia (also known as Gafudji Mekanisi), 20, had a pre-existing aneurysm, a weak spot in a blood vessel, the lawsuit filed in Orange County Superior Court on Wednesday claims the ride was unsafe and caused her death. The coroner's office attributed the death of the woman, a visitor from Africa, to a ruptured aneurysm, and the state Division of Occupational Safety & Heath concluded that the ride was operating properly at the time.

Just once I'd like to see a park stand up to these idiots and actually take it to court, and also counter sue for the costs involved with taking such a lawsuit to court.

Geez, giving how paranoid Knott's employees are with the stapling and everything, what will we have to do next? Show a clean bill of health before we get on every ride?

I don't think her family should get a dime. She may have not known about her pre-existing condition but Knott's is in no way responsible for this. You ride at your own risk, period.

Stupid lawyers? No. Some are just greedy and thrive on the misfortune of others.

The worst day at Cedar Point is better than the best day at work.

I really hope that these parks quit settling their cases, and that Knotts doesn't and starts a trend, because that's what I fear may happen, and that's almost admitting fault. This woman's family has NO CASE here, Knotts just needs a decent lawyer, and he'd have no trouble getting them off the hook, this is ridiculious that there's even a suit being filed. I really hope that they take it to court and take a stand for the entire entertainment industry, these people deserve nothing, I'm sorry about the death in their family, but they don't need to pass the burden on to other people, just take it for what it is, a little something called LIFE!

Why are they waiting till' now to bring this up? Thats what I always wonder, why the family waits to bring it up a year after it happened.

If you like Wicked Twister in the back, does that mean you like to get screwed in the rear?

There is no case. I'd love to see how they plan to prove this case. Roller Coasters are fast and furious. The first time I road Shockwave at Great America I thought I had gone to heaven. I had the biggest headache, but that was because I was just tall enough to get on the ride at the time. My head rattled around in the harness the entire ride.

I'm pretty stupid now so do I sue Six Flags for making an incredible coaster?

Well, it could be claimed unsafe, as there is a certain degree of subjectiveness to that term,

Yep, but then that tall blade of grass in my yard could be claimed unsafe too, as it could be tripped over. :)
how stupid is this. i think the family just wants money.

It's not like the employees of the amusement park had "X-ray vision" and could see this problem ahead of time. This family is simply using Knott's as a scapegoat to try and get money. It's rediculous how greedy people are these days.

Hold on here, kids. I'm sure the only thing the family really wants is their kid back. When someone close to you dies, even if it's in thier sleep, you go through a phase of anger and you want someone to pay.

Lucky for them, a lawyer who has made a career of going after amusement parks stepped in to help them deal with their anger.

My hope is that Cedar Fair does not settle out of court, because someone in the industry needs to step up to the plate with expert testimony and put this silly trend to rest. The side benefit is that the industry as a whole can get up and show the world that even the courts side with their assertion that the rides are indeed safe.

The problem is that we live in a world where suing has become the culture. If some overweight people can sue MacDonalds for making them overweight (as I believe is happening somewhere in America) then quite honestly anything goes.Perhaps a good lawyer could argue that the rollercoaster could exhert forces capable of causing a brain hemorrhage to someone with this unknow condition and therefore the park are in some way responsible. I don't think anyone with an ounce of sense would agree with that, but common sense doesn't matter when there is money to be gained.

I think Cedar Fair should go to court, win, and then turn around and sue the family. These people shouldn't do this without getting in trouble. I think if anyone tries to sue a company or another person and loses, they should go to prison or pay exuberant fees. Maybe that will stop this craze. The U.S. legal system should be a tool of justice, not a golden ticket to riches.
