Park officials and witnesses described seeing a large branch fall across the tracks at about 6 p.m. Monday, causing the partial derailment, but a spokesman for the California Division of Occupational Safety and Health, Peter Melton, said an entire tree -- estimated at 40 feet high -- had actually fallen.
Two Six Flags Magic Mountain visitors who were riding the Ninja roller coaster when it struck a downed tree Monday sued the park, seeking unspecified damages.

I heard the tree is being taken out of the ICU, and is making a steady recovery. The Tree's lawyers refused to comment on the current situation.
I think we should leaf this alone. The lawyer for the tree is probably all bark and no bite anyway.
