Family sues Paramount's Kings Island after guest struck by lightning in parking lot

A Cincinnati lawyer has filed suit against Paramount's Kings Island on behalf of a family that says the park should have warned of an approaching storm and lightning that struck Shawn Perkins and caused significant brain damage.

MagnumForce: You are still missing the point. You can't argue that operating a saw in the "way in which it was intended" will result in the cutting off of your hand. McDonald's, however, was serving coffee, when used as intended (i.e. you drink the damn thing!) caused injuries. Serious injuries. People received burns when, blowing on the ridiculously hot, unnecessarily hot, warned-by-the-FDA it was too hot, near-boiling-hot liquid, some spilled onto their hands.

Of course we're all in favour of personal responsibility. But there's also something known as corporate responsibility, and if a company acts with reckless disregard for the safety of its consumers than they can (and should) be held liable.

And *everyone* continues to miss the point that a lawyer can *not* win a case without a jury taking his or her side! As a citizen of the United States, it is your responsibility to serve on a jury when called upon, and make the right decision. So it doesn't matter how many so-called "frivolous" lawsuits are brought to trial, because they still have to stand up to the jury's decision. The fact that juries have awarded money in many of these cases really shoots down anyone's theory that they were somehow ridiculous cases, since ordinary people like you and me sided with the "money grubber."

Suing cigarette manufacturers because you smoked their product and got sick. Even with all the warnings on the label.

Trying to sue gun manufacturers because a criminals use guns to shoot people.

Trying to sue fast food chains because you are too fat.

Suing a bar because they served you too much beer and you crashed your car.

Suing a railroad because you drove your car around the gates and got hit by a train.

What could be next? Suing the BIG THREE because they sell their cars to drunk drivers? Suing your cell phone provider because you were talking when you should have been driving? Where will it end?

Just goes to show that people do not want to take responsibility for their own actions. I think "white trash lottery" hits the nail on the head. Maybe I should sue the place that just delivered my very messy chicken wings. I dropped one and it stained my carpet..it's THEIR fault darnit!

Way to go Drake.........lawyers, geez.

We are humans, not cattle, I am sure he could tell bad weather was coming. Oh wait, maybe his neck had a nerve pinched, and he couldn't look up at the sky. Maybe Drake can sue the victim's doctor for failing to refer him to a chiropractor to get his neck checked out. Drake can then include the local weatherman in the lawsuit for failing to instruct the victim not to park his car in that spot, and not to go to his car at that exact time, for a lightning bolt was about to hit!!! Maybe he can include Dr. Emmett Brown and Marty McFly in the suit.

I do feel bad for that guy though. Well, it was either that or the lottery

The lady that sued McDonalds for spilling the coffee in her lap. It seems that she did it herself. Ever heard of waiting till it cooled off some before drinking if it's too hot. Kings Island did show reasonable care for it's guests by making sure everyone was off the rides before that storm hit. Perkins is a plain idiot for trying to get into his car in a lightning storm. If I see a storm coming with lightning and I am in any amusement park. I will head to the nearest shelter until that storm passes over. Perkins won the lottery as far as being struke by lightning goes. IT"S AN ACT OF GOD not the amusement park's responsibility to make sure I can get to by car without getting hit by lightning. Once you leave the park itself you are on your own and that includes the parking lot.
I should sue myself for reading the article.

Just a few notes...

-Spike Lee actually won that dumb lawsuit? Wow...

-One of the safest places you can be in a thunder/electrical storm is indeed your car... But not because the metal around you conducts the electricity. A car won't get struck!! Its because the RUBBER TIRES insulates the car from being grounded. When lightning strikes, its an electrical imbalance trying to even itself out. Nature wants to be neutral, or no charge. Lightning is a jump of electrons flowing from a higher concentration (the cloud) to a lower concentration (Earth). It will always take the path of least resistance, which is not a car where it has to go through 4 non-conductive tires...

-The Catch 22 to the car deal is that you have to go through the entire, flat parking lot full of non-conductive cars to get to the safety of yours... Guess what, you just became the path of least resistance.

-This lawyer has a very imaginative mind if he thinks for a second that PKI is responsible. And heres the worst part... Say some crackpot jury awards this family millions and millions of dollars, it could really cripple PKI. Their insurance probably won't cover it!! Read your own insurance policy for you car or home. 99% of them will say right in them that they don't cover acts of God! Even the World Trade Center wasn't covered because the insurance policies didn't cover acts of terrorism. I'm curious to see how this turns out...

Jeff so what youre saying then is a lighting rod on a house is useless if it's dripping rainwater onto the house... The car is not the path of least resistance because it has 4 rubber tires that do not conduct electricity. Same reason electricians where thick rubber-soled boots on the job, it helps insulate them from the ground.

No, the electricity still passes to the ground, but the car is not isolated from the ground. A lightning rod still passes the electricity through the cable (as it is the path of least resistance), but the house is still grounded, just as a car is by way of the water dripping off of it.

If any judge takes this case and doesn't throw it out of courty then there is a real problem here with with ridiculous law suits.
Maybe I should sue these people for filling their suit. Because I think they have injured me by killing some brain cells of mine with their assnine ideas. If you see the rides shutting down and a storm comming you would have to be a complete idiot to not think there is a chance of lighting. And for that matter why don't they sue the state of Ohio for allowing lighting in their state to begain with.

GET REAL PEOPLE!!!!

Plainly, someone is trying to get some free money to off-set their medical bills. Meanwhile, the murder and rape and homicide crimes get delayed from trial.

All you have to do is look at the sky to see if theres a storm. I wonder if this guy acts like a child, having people telling him whats coming instead of figuring it out by himself.
