Family sues Indiana beach over coaster

Owners of property near the CornBall Express Roller Coaster at Indiana Beach claim the ride is depriving them of the enjoyment of their summer cottage, and have filed a suit seeking more than $1 million.

I'm gonna get poop for this. These people are from the 'north shore' of Chicago. This suburban area has a reputation of being extremely well off, greedy, full of attitude, etc. (high school hazing, anyone?) People who deliver food, etc. and work in the 'service' industry really don't like going there (myself included). Granted, there are actually some VERY NICE people up there, but reputations are there for a reason.

It's too bad, this seems like total greed. Maybe they should go somewhere in Wisconsin for a summer home. It will be a much quicker trip in their lexus. Wonder if they have ever been on the Cornball Express, how can anyone not adore that ride?

Well, talking about getting POOP for something. I don't adore the ride. It's good, but I got a big ol' nasty case of anticipointment from it. Then, to make matters worse, I had to wait another 15 minutes before my first lackluster ride could be amended.

Boy Brian, if THAT ain't the truth. Anticipointment CENTRAL! I did enjoy it as the day wore on, but it took a couple of first car rides. That whole save-money-don't-run-the-train-until-it's-mostly-full thing is maddening. :( The waits should be 2 mins, not 15 to 30.

Those "summer cottages" seemed more like lakeside trailer parks to me. I'd be shocked if they were actually worth anything in the first place.

Besides, surely IB had to go through the city to get the ride approved. If the people had a problem with the ride, they should have expressed it at that time.

Well, tyhe City of San Jose had a similar case way back in the early 80's when the airport wanted to expand from a muni to an international terminal. The neighborhood at the end of the runway wasn't too thrilled with the prospect of noise and so the city ended up buying the entire neighborhood and demolishing the houses.

In fact, if you ever fly into SJO, you'll notice a strange plot of land inhabited with plants that you would normally find in a neighborhood, but no houses.

Sounds just like the people that build next to an airport and then complain about the jet planes flying overhead. Or those who buy a house next to an interstate highway and then make the state build a sound barrier. We need to pass a law that would just through out frivolous cases like this!

It's greed...plain and simple, and it's disgusting! They should sell the place, and move to the one sisters place in Florida, move in next to Disney, and complain about the noise there too. Hey ladies, if it's possible...get a grip on reality!

Beware of Kiddie Coasters

When we were up there in June, Abby Leigh and I crossed the swinging bridge and walked around over there.
l. There are only two homes over there worth any significant amount of money: The Black Dog Bed and Breakfast, and the house down on the point across from the Ferris Wheel. The other homes are merely vacation cottages, no matter if their owners live in them year round or not.
2. The homes are across the water. We actually took photographs from several vantage points where we could get a good angle between trees and houses. The noise from any of the rides is very soft over there. Boats cruising back and forth on the water are louder.
3. The park has been there longer than any present owner of any of those homes.
4. Many members of this site would kill to have a home across the water from a park with several good rides, wshere they could either sit out on their patio and watch, or go over and ride. if these people don't like it, let them sell to an enthusiast.
5. Most parks are kind of isolated. The only other major park I know with that many homes that close is Kennywood and the noise and lights are worse there. But nobody complains.
Hmm...perhaps I should start sueing,

Lets see I can could sue a few things because of noise, the railroad right next to me, the church bells across the street from me or perhaps the airplanes that fly over me landing and taking off from Midway.

Maybe I should sue about this empty lot at the end of my block that the village has said was going to be a parking lot, but now is going to be a 5 story apartment complex.

Or maybe not, because im not greedy and looking for money. And I live around this for the whole year, not just for the summer.

I hope Indiana Beach can win this case, the park was there before they were..just plain greed is how I see it.

This kind of reminds of Knott's on plenty more than a single occasion...
Although I have never been to indiana Beach these people being near the cornball express and their property values decreasing is by their own fault.....

When they bought that peice of property they knew it was near an amusement park and if they didn't want to be near the amusement park they should have bought a cottage somewhere else . Also they should have also figured on the amusement park expanding ..as all buisnesses that are making money ...and doing well...often do.

I've never been to IB, I have no idea where the house is located, but personally, I can't see the value of a "vacation" property being lowered due to the amusement park and coaster noise next door.

Anyone who has any sense could see the possible value in renting a place such as that to people who are there visiting the park for a few days. How many people would love to rent a nice cottage on a lake near an amusement park.

One, the house is across Lake Shafer from the park. From that distance you can barely hear the park, especially if you are inside. Besides the Hoosier Hurricane is closer to the house than the Cornball anyways, so why didn't they complain before? Two, the property I can bet has actually increased because of IB. People flock there from the area to their summer cottages and they are definatly in high demand. Plus Indiana Beach is the jewel of Monticello, it is the biggest employer in all of White county. I know this case has a very high possibility of being thrown out.

The cottage is behind the park, not across the lake. It's near the picnic shelter that is behind the Tig'rr.

Local paper reported today that both parties' lawyers will try to mediate next month.

Someone needs a good fist in the teeth. This is so rediculouis. IB is one of the MOST PERFECT "parks" I am privelegeded to visit. This is rediculouos.... That park is like Kennywood on the water, near perfect. I had wished they would buy the TIDAL WAVE, but it is one of the most perfect parks I can think of.
I could probably suee Houston for the inconvinience they've created with the road work, and I could probably sue the people behind my house for playing music outside while they are in their pool, but i wont, because that is stupid and normal people get a job. Lawsuits in general are stupid now. Its like people suing PKI for the lightning. I feel like sueing these people for lessening the image of mankind.
This will be held in an Indiana court, which tend to be very conservative in their rulings. There is no way in hell these people will be able to follow through with the suit. I wouldn't be surprised if it's thrown out completely. In Indiana people that move close to farms can't sue the farmers for the smell of their livestock...noise pollution is quite similar in this case.

Ya know, I really don't understand. What are they going to do with the million dollars? Find another cottage? I don't think they need that much. What would really kill me was if they weren't going to move, but still wanted that money. It's like "give us the money and we'll shutup". Kind dumb to me...

First of all Indiana Beach is a very lucurative business. These "ladies" did not own that cottage, it was a gift from their parents. If they had any sort of brain they would realize that a law suit is not going to be profitable. Selling their property would bring more money than their stupid law suit. You can't touch property in monticello on the lake now. In fact if it bothers them so much maybe they should look into selling to the beach itself.

Also, I frequent Indiana Beach every summer. I stay in the park itself. There is no noise before 11 a.m. and at 11 p.m. exactly it ends. The IB sercurity is very diligent in keeping thing quiet.
