Court says Falfas should be reinstated, with back pay, as Cedar Fair COO

In June 2010 Cedar Fair Entertainment Co. announced the resignation of Jacob T. “Jack” Falfas, the chief operating officer who had worked for the company for 39 years. But Falfas challenged the end of his employment with Cedar Fair and this month a court ruled he should be reinstated to the job. The decision came out of the 6th District Court of Appeals in Toledo.

Somehow I doubt that he will even step foot in the office. I'm sure there is some exit clause in the contract, even if it just means paying what he's due and sending him on his way.

As much as I think he probably deserves it, I hope he doesn't. (from a unitholders standpoint)

The two comments on PointBuzz's Facebook page are unkind.

The way the company is on a roll, I can't imagine doing anything to upset that. On the spectrum of management philosophy, I suspect Falfas leans more toward Kinzel than Ouimet. Nobody wants that.

According to the article, the Erie Common Pleas Court ruled he was entitled to back pay and benefits, but not reinstatement. That was what he appealed to the 6th District Appeals Court in Toledo where he has now been granted back pay, benefits, and the reinstatement.

Certainly sounds like he was fighting to get back in the door. He could have taken the money he was owed and just walked away, but he didn't. Wonder if he's changed his mind recently given all of the change at the park.

Could definitely get awkward.

Seems like an odd result in that people are typically not forced to associate with each other (though ultimately I don't think anyone will be). Falfas is likely to get paid everything due under the contract. Initially the court ruled he was wrongfully terminated and was entitled to back pay. Now he can get pay going forward to the end of the contract. His attorney is trying to establish that Falfas is ready, willing and able to perform his part of the contract going forward. So Cedar Fair has the choice of bringing him back on board at the company for the remainder of the contract or paying him what he otherwise would have received.
